You also guarantee that the information provided by you (including payment details) is correct and complete.  We will not share this information with anyone for any reason other than fulfilling our obligation to you. By submitting your order for processing, you confirm that you are the person referred to in the Billing details.

You are responsible for maintaining the confidentiality of all personal details relating to the website (including your account and password). You agree to take responsibility for all activities that are performed under your account and password. You will be responsible for access and use of the website by anyone using your account and password, including all actions and obligations during such use of the website.  You agree to notify TopWhiskies immediately regarding any unauthorized use of the User's account or any other violation of security. We keep the right to refuse service, cancel accounts, or cancel orders, where we expect misuse.

Visitors under the age of 18 should not submit any information, or any order, to TopWhiskies and should not register with the website. TopWhiskies uses AgeChecked to verify our customers' ages.

These Terms and Conditions constitute the entire agreement between you and TopWhiskies Ltd (“we” or “us” or “our”)  and govern your use of the website, superseding any prior agreements between you and us with respect to the website.

We will not be responsible for any delay or failure to comply with our obligations under these Terms and Conditions if the delay or failure arises from any cause beyond our control. Where applicable, we reserve the right to cancel and refund orders in situations that are beyond our control.

No agent or representative of ours is authorized to make any warranties, representations or statements regarding the products and we shall not in any way be bound by any such unauthorized warranties, representations or statements.

We reserve the right to change or remove (temporarily or permanently) the website or any part of it without notice and you confirm that we shall not be liable for any such change or removal.

We are registered under the Data Protection Act 1998 and as such, any information concerning you and your respective records may be passed to third parties. However, your records are regarded as confidential and therefore will not be divulged to any third party, except if legally required to do so by the appropriate authorities. You have the right to request sight of, and copies of any and all records we keep, on the proviso that we are given reasonable notice of such a request. You are requested to retain copies of any literature issued in relation to the provision of our services. Where appropriate, we shall issue you with appropriate written information, handouts or copies of records as part of an agreed contract, for the benefit of both parties.

Products

Some of our products are limited editions. This means availability can only last while stocks remain, and availability is subject to change at any time without notice.

Everything is done to be sure that photographs and descriptions of each product are correct. However, errors regarding product information, tasting notes, photos or typographical errors, may occur; please contact us at hello@topwhiskies.com if you feel something is incorrect.

Prices

Everything is done to be sure that prices presented on the website are correct. However, errors regarding product prices may occur.  If we discover an error in the price of a Product you have ordered we will contact you. Prices are subject to change at any time without notice.

Discounts and offers

Only one discount or special order can be used per order.

Taxes, customs and import duties

All alcoholic products we sell are sold subject to UK alcohol tax. 

Your order could be subject to local sales taxes and duties upon arrival in the destination country. All additional charges are the responsibility of the recipient. As customs policies vary widely from country to country, we have no control over these charges, so you should contact your local customs office for further information.

If you refuse to pay any import duties and taxes, this could result in the goods being destroyed by customs or being returned back to us - any refund offered would include a deduction of our costs.

Age Verification

We believe in responsible drinking, which includes making sure you're old enough to enjoy a dram. The equivalent of asking to see your ID is a service called AgeChecked. Its an entirely secure and safe way for us to check you are of legal age, AgeChecked are an industry-leading service regulated to regulated to BSI: PAS1296. 

When you place an order, our system works with AgeChecked's system to check records which evidence your age. Once you place your order verification is quick and simple, happening behind the scenes. We can then post your delicious whisky out to you.

Key facts:

Confirmation of Order and Invoice

After payment, you will receive via email a confirmation of your order. Should you need to retrieve your invoice, you will be able to access it via your email confirmation, or view it by logging in at topwhiskies.com and select “view your orders/invoices”.
